H-1B Petition Procedures for New International Faculty/Staff Employees

Before Hiring Nonimmigrant Faculty

  1. Request H Request Forms from Heesun Majcher and fill out the forms
    • Complete two H Request Forms
      • One for Department
      • The other for the Beneficiary
  2. When the H Request Forms are fill out, forward them to Heesun together with
    • $320 Filing Fee for I-129 (subject to change)
    • $500 Anti-Fraud Fee
    • Optional Premium Processing $1000
    • All the other supporting documents from the Department and the Beneficiary
  3. Heesun will process and submit the petition for the H-1B employment to USCIS with the fees, Labor Condition Application(s), and supporting documents.
  4. Upon the receipt of the Petition, USCIS will mail an Original Receipt Notice to Northern Illinois University.
    • A current H-1B worker transferring to NIU will be able to begin to work upon the receipt of the Original Receipt Notice.
  5. Upon the approval of the Petition, USCIS will mail an Original Approval Notice to Northern Illinois University.
    • An F-1 or J-1 non-immigrant will be able to begin to work in an H-1B status at NIU only upon the receipt of the Original Approval Notice.

Any substantial changes in working conditions of H-1B workers including duties, wages, work sites or others will require an amendment to the Labor Condition Application and the Petition. NIU must submit a petition and receive an Original Receipt Notice before implementing the change(s).
