Pursuant to 10 ILCS 5/17-15, employers must allow two (2) hours for employees entitled to vote on Election Day when the following criteria are met: 

  • The election is a general, special, or election where propositions are submitted to a popular vote in the State;
  • The request for leave is made prior to election day; and
  • The work schedule of the employee begins less than 2 hours after the opening of the polls and ends less than 2 hours before the closing of the polls.

Because the polls are open in Illinois from 6:00 a.m. to 7:00 p.m., most employees will have adequate time to vote before or after work.  However, employees’ eligible to vote and meeting the above criteria may receive release time to absent themselves from services or employment for a period not to exceed two (2) hours during polling times.  Operational needs may be taken into account in scheduling any requested release time.
